These Terms of Service ("Terms") form a binding agreement between you and PostaraTrend Technologies Inc. ("PostaraTrend," "we," "us," or "our"). By accessing our website, creating an account, or using our service in any way, you agree to these Terms. If you do not agree, do not use our service.

The Service is not intended for, and we do not knowingly provide it to, persons or organisations restricted by Canadian sanctions law or by applicable trade-control laws of the countries in which we operate.

We may suspend or terminate accounts that contain false or misleading information, that show signs of compromise, or that violate these Terms.
The Service is offered on subscription plans. Plan features, fees, and any usage limits are described on our Website or in your order form. We may change pricing or plan structures from time to time; we will provide reasonable advance notice of changes that affect your active subscription, and changes will take effect at the start of your next renewal period unless you cancel.
Subscription fees are charged in advance, on a recurring basis (monthly or annually, as selected at signup), to the payment method on file. Unless otherwise stated, fees are exclusive of applicable taxes, which we will add where required. By providing a payment method, you authorise us and our payment processor to charge that method for all amounts due.
Except where required by applicable consumer protection law, fees paid are non-refundable. We do not provide refunds or credits for partial subscription periods, unused features, or downgrades made mid-cycle. If you believe you have been billed in error, contact us within 30 days and we will review the matter in good faith.
If a payment fails, we may retry it, restrict access to the Service, suspend your account, and ultimately terminate the subscription. You remain liable for fees accrued prior to suspension or termination.
The Service requires you to connect one or more third-party social media accounts (for example, Facebook Pages, Instagram Business Accounts, TikTok, YouTube, or LinkedIn). When you connect an account, you authorise PostaraTrend to access and act on that account through the platform's official API, only within the scopes you approve.
You represent and warrant that:
You may disconnect any account at any time from within the Service or from the relevant platform's settings. Disconnection ends our access prospectively but does not retroactively undo content already published.
You agree that you will not use the Service, and will not allow anyone using your account to use the Service, to do any of the following:
Without prior written approval from PostaraTrend, you may not use the Service in connection with any of the following industries or content categories:
You retain ownership of all content you submit to the Service or instruct the Service to publish ("Your Content"). By submitting Your Content, you grant PostaraTrend a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and publish Your Content on the platforms you have authorised, solely for the purpose of providing the Service to you.
You are solely responsible for Your Content, including its lawfulness, accuracy, and compliance with the policies of every platform on which it is published. PostaraTrend does not pre-screen, edit, or endorse Your Content.
If we receive a credible complaint or detect a clear violation of these Terms or of platform policies, we may remove or refuse to publish Your Content, restrict your account, and notify the relevant platform.
The Service uses artificial intelligence to detect trends, generate copy, generate visual elements, render video, and recommend posting schedules. AI-generated content may contain errors, inaccuracies, or unintended outputs. You are responsible for reviewing AI-generated content before it is published, configuring approval and human-in-the-loop controls appropriate to your governance requirements, and ensuring that final content complies with applicable laws and platform policies.
PostaraTrend does not warrant that AI-generated content will be accurate, fit for any particular purpose, free of bias, or free of similarity to existing third-party works.
The Service, the Website, and all underlying software, design, content, trademarks, and documentation (other than Your Content) are owned by PostaraTrend or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms. Nothing in these Terms transfers ownership of any of our intellectual property to you.
You may not use our name, logo, or other trademarks without our prior written consent, except that you may identify yourself as a customer of PostaraTrend in a factual, non-disparaging manner.
The Service depends on third-party providers, including without limitation Meta (Facebook and Instagram), TikTok, YouTube, LinkedIn, Anthropic, Apify, Creatomate, our hosting and payment processors, and other vendors. Your use of those services is governed by their own terms. PostaraTrend is not responsible for changes, outages, or actions taken by third-party providers, including changes to their APIs, policies, or pricing that may affect the Service.
From time to time, we may make features available on a beta, preview, or early-access basis ("Beta Features"). Beta Features are provided "as is" for evaluation, may be unstable or unsupported, and may be modified or discontinued at any time. We may collect additional usage data from Beta Features to improve them.
Except as expressly stated in these Terms or in a separate written agreement with you, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation.
We do not warrant that the Service will meet your requirements, that operation will be uninterrupted or error-free, that defects will be corrected, or that any specific content, audience reach, engagement, revenue, or business outcome will result from your use of the Service.
To the maximum extent permitted by applicable law:
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any such limitation is not permitted, our liability is limited to the smallest extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless PostaraTrend, its directors, officers, employees, contractors, and affiliates from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms or of any law; (d) your violation of any third-party right, including the policies of any connected platform; or (e) any dispute between you and a third party whose account you connected to the Service.
These Terms apply from the time you first use the Service and continue until terminated.
You may terminate at any time by cancelling your subscription and closing your account. Cancellation stops future renewals; it does not entitle you to a refund of fees already paid except as provided in Section 4.3.
We may suspend or terminate your access to the Service, with or without notice, if:
On termination, your right to access the Service ends, and we may delete your account data after a reasonable period subject to our Privacy Policy and any retention obligations imposed by law. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — survive.
We may modify, add to, or discontinue features of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide reasonable notice — for example, by email to your account address or by a notice on the Website. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by, and shall be construed in accordance with, the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.
Subject to the next paragraph, you and PostaraTrend agree to the exclusive jurisdiction of the courts of the Province of Alberta sitting in Calgary, Alberta, for the resolution of any dispute, claim, or proceeding arising out of or relating to these Terms or the Service.
Nothing in this Section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights, confidential information, or other interests where monetary damages would be inadequate.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
